1. Acceptance of Terms

By downloading, installing, or using the Kooya mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a binding legal agreement between you and the Kooya Team ("we," "us," or "our").

2. Description of Service

Kooya is a photo organization tool designed to help you manually sort, clean up, and organize your photo library.

• Manual Control: The App gives you full control over your photos. It does not make automatic changes or deletions without your explicit action.
• Age Requirement: The App is intended for users aged 17 and older. By using the App, you represent that you meet this age requirement.

3. User Accounts

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information (Name, Username, Email).
• Maintain the security of your password and identification.
• Accept all responsibility for any and all activities that occur under your account.

4. User Conduct

You agree not to use the App to:

• Upload or organize content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Violate any applicable local, state, national, or international law.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Interfere with or disrupt the integrity or performance of the App.

5. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal data.

6. Intellectual Property

The App and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of the Kooya Team and its licensors. The App is protected by copyright, trademark, and other laws of both the country of origin and foreign countries.

7. Subscription and Fees

If the App offers paid features or subscriptions:

• Fees are billed in advance on a recurring basis.
• You may cancel your subscription at any time through your App Store account settings.
• Refunds are subject to the policies of Apple's App Store.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. The Kooya Team makes no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, or materials included therein. You expressly agree that your use of the App is at your sole risk.

10. Limitation of Liability

In no event shall the Kooya Team, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Kooya Team is established. Any dispute, controversy, or claim arising out of or relating to these Terms shall be settled by binding arbitration.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
